NYC Window Safety Bar Law: What Every Renter Needs to Know

NYC requires window guards in apartments with kids ≤ 10 — but there's a lawful AC install exemption. Here's the full rule.

If you live in a NYC apartment building with three or more units, and a child age 10 or younger lives with you, your apartment is required to have window guards on every window — and you can't just take them off to install an air conditioner.

But the law does allow an AC install — with specific safety bars and procedures. This guide explains what's required, what it costs, who's responsible, and the lawful path to a cool apartment that keeps small children safe.

The law itself

NYC Administrative Code §27-2043.1 (also known as Local Law 57) and NYC Health Code §131.15 together create the window guard requirement.

The rule:

  • Applies to buildings with three or more units.
  • Applies to apartments where a child age 10 or younger resides.
  • Owners must provide and install approved window guards on every window, including first-floor bathroom windows and windows opening onto balconies/terraces, plus all common-area windows.
  • Tenants cannot remove window guards — even to install an AC.

The AC install exemption

The law allows a permanent AC install in lieu of a window guard for that specific window, but only if three conditions are met:

  1. The AC unit is securely bolted into the window stool or sill using tamper-resistant one-way screws, leaving no open space greater than 4½ inches.
  2. Two metal "L"-shaped stops or brackets are installed in the window frame (one on each side of the bottom sash) to prevent the sash from opening more than 4½ inches above the AC unit.
  3. The building owner has inspected and approved the install, and verified the above two conditions are met.

That third requirement is often skipped in casual installs — and it's the one that creates legal exposure for both the landlord and the tenant if an accident happens.

For non-permanent rentals (most of us)

Most NYC AC installs are seasonal — they go in in May and come out in October. They don't qualify as "permanent" installs and therefore can't substitute for a window guard.

The lawful solution: install a window safety bar across the open sash gap above the AC. This is a tamper-resistant horizontal bar that prevents a child from climbing over the unit and out the window.

  • Standard window safety bar (windows up to 46″ wide): $50 installed.
  • Wide window safety bar (windows wider than 46″): $60 installed.
  • Goes in during the same visit as your AC install.
  • Removed in October when the AC is removed.

What the safety bar looks like

It's a steel bar, similar in profile to a window guard, installed across the gap between the top of the AC unit and the bottom of the upper sash. The bar is fixed in place with tamper-resistant screws into the window jambs. It allows airflow but prevents a child from leaning out or falling through the gap.

Who's responsible for what

Landlord responsibilities

  • Provide and install approved window guards on every window.
  • Survey tenants annually about children under 10.
  • Approve and inspect permanent AC installs that substitute for guards.
  • Maintain window guards in working condition.

Tenant responsibilities

  • Notify the landlord, in writing, if a child age 10 or younger lives in or visits the apartment regularly.
  • Do not remove window guards.
  • Use a window safety bar (or qualifying permanent install) any time an AC is installed.

Penalties

For landlords: failure to install window guards is a Class C violation under HPD, with fines of $500–$1,500 per window per violation. In cases of injury, civil liability is substantial.

For tenants: removing window guards or interfering with their function is also a violation. More importantly, if a child is injured, the consequences are far worse than the regulatory fine.

What happens when you book with us

Common questions

"My kid is older than 10. Do I still need a safety bar?"

Legally, no. Many parents still opt for one — kids visit, grandkids visit, accidents happen. The bar is optional once kids are 11+.

"My building doesn't have window guards installed at all. What do I do?"

Notify your landlord in writing that you have a child under 10 and request window guards installation. Keep a copy of your notice. If they don't respond within 14 days, you can file a complaint with HPD via 311.

"What if I don't want to tell my landlord I have a child?"

We can't legally help install an AC without the safety bar in apartments with a child under 10. Even setting aside the law, the risk of a window-fall accident is not worth the privacy concern.

"Can I install my own safety bar?"

Technically yes — they're available at hardware stores. In practice, an improperly installed bar is worse than no bar. Our installers use tamper-resistant one-way screws into structural framing, not drywall. Cost is $50 and the install is included with your AC visit.

Bottom line

If a child age 10 or younger lives in your apartment, you need a window safety bar with your AC. It's $50, it goes in during the same visit as the AC, and it prevents the most dangerous failure mode of a window AC install: a child falling out.
